What is a due date and why it matters
The “due date” is the date prescribed under legislation — an Act of Parliament or a State Assembly, or subordinate legislation such as rules framed under the various Acts — or mandated by a circular or notification of a government office such as GST, Income Tax, ROC, RBI, PF, ESIC or Professional Tax.
In companies, the directors, CFO, Company Secretary and managers — collectively the Key Managerial Personnel (KMP) — are jointly or severally responsible for meeting the compliance filings within their due dates; in an LLP the designated partners are responsible. In a sole proprietorship the proprietor, and in a partnership firm all the partners, are the responsible persons. Non-filing of the prescribed returns before the due dates results in penalties and, in some cases, prosecution. We therefore strongly advise you to comply with the legal requirements.
⚠️ Consequences of non-compliance
Penalties and fines
Reputational damage
Legal action, such as an audit or investigation
Critically affects future funding
Creates doubt on business continuity
Credit risk
