Insecticide Registration Process

To obtain registration for an insecticide in India, applicants are required to compile a comprehensive dossier containing essential data. This dossier must encompass vital information, including the insecticide’s chemical composition, toxicity profile, efficacy, and environmental impact.

The CIBRC assumes the responsibility of meticulously reviewing the submitted dossier and may conduct its own rigorous tests when deemed necessary. Only when the CIBRC is thoroughly satisfied that the insecticide meets stringent safety and effectiveness standards will it grant a registration certificate. Step-1: Application Submission

To initiate the registration process, applicants must complete Form I. All the required particulars specified in the form must be filed appropriately. The form should be signed by the appropriate authority depending on the entity type. Moreover, any changes in the composition of Hindu Undivided Families, partners, Board of Directors, or the person in charge must be promptly reported to the Secretary, Central Insecticides Board and Registration Committee, and the Licensing Officer.

Step-2: Verification of Data

The Registration Committee may, if necessary, direct an inspection of the testing facility to authenticate the data provided. Upon receiving an application, the Registration Committee conducts an inquiry to verify the insecticide’s efficacy and safety claims.

Step-3: Payment of Insecticide Registration Fees

Applicants are required to submit a bank draft drawn in favor of the Accounts Officer, Directorate of Plant Protection, Quarantine & Storage, payable at Faridabad, as the Insecticide registration fees. The fee amount for applications of unregistered insecticide is Rs.5,000. For applicants who apply for registration of already registered insecticide in the name of another person is Rs.2,500.

Step-4: Insecticide Registration Certificate Granted!

If satisfied, the Committee registers the insecticide, assigns a registration number, and issues a certificate within twelve months. The Committee may extend this period by up to six months if needed. The Certificate of Registration will be issued in either Form II or Form II-A, depending on the circumstances, and will include specific conditions as prescribed.

Note:

  1. Each insecticide must have a separate registration application.
  2. All types of insecticides, including chemical insecticides, biopesticides, and pheromones, can be registered in India. Find the list of insecticide permissible for registration.
  3. In cases of a new insecticide introduction in India, the Committee can grant provisional registration for two years, subject to specific conditions.
  4. The Committee can modify registration conditions based on insecticide efficacy and safety. Certificate-holders may be required to return their certificates within a specified time if conditions change.
  5. Regardless of the section’s provisions, other entities can apply for registration of an already registered insecticide. They will be granted registration under the same conditions as the original registration upon application and fee payment.

Penalty for Not Obtaining Insecticide Registration

Selling an unregistered insecticide in India carries serious consequences under the Insecticides Act, 1968. For a first offense, the penalties can include imprisonment for up to two years, a fine ranging from ten thousand to fifty thousand rupees, or a combination of both. In the case of second and subsequent offenses, the repercussions become even more severe, with imprisonment potentially extending to three years and fines ranging from fifteen thousand to seventy-five thousand rupees, again with the possibility of both imprisonment and fines.

Duplicate Certificate:
In case the original Certificate of Registration is lost, defaced, or damaged, a duplicate copy can be obtained by paying a fee of Rs. 100 in the form of a demand draft drawn on the State Bank of India, Faridabad, in favor of the Accounts Officer, Directorate of Plant Protection, Quarantine & Storage, Faridabad, Haryana.

Modifications to Registration:
Any additions, deletions, or alterations to the Certificate of Registration, including labels and leaflets, require a fee of Rs. 100 for each occasion. This fee should be paid through a demand draft drawn on the State Bank of India, Faridabad, in favor of the Accounts Officer, Directorate of Plant Protection, Quarantine and Storage, Faridabad, Haryana.

Appeal Process:
If you disagree with any decision made by the Registration Committee, you have the right to appeal. The appeal process involves the following steps. File your appeal in duplicate using Form II-B and submit it in writing to the Central Government in the Department of Agriculture. Clearly outline the grounds for your appeal under distinct heads.
A fee of Rs. 100 is required for filing an appeal. This fee should be paid through a demand draft drawn on the State Bank of India, New Delhi, in favor of the Pay and Accounts Officer, Department of Agriculture & Cooperation, New Delhi.

Publication of Refusal or Cancellation:
It's essential to note that any refusal to register an insecticide or the cancellation of a certificate of registration will be publicly disclosed. This disclosure includes publication in two English and Hindi newspapers with substantial circulation in India and in journals published by the Department of Agriculture, Government of India.
