Furthermore, the team provides expertise in intellectual property advisory services and filing coordination, general business consulting, documentation preparation, coordination with government departments, and overall project management and administrative support, ensuring that all services meet applicable legal standards and Setindiabiz's high-quality benchmarks.
  • When We Engage Independent Licensed Professionals: For specific services that require a licensed professional by law or regulation to provide, attest, certify, or represent, we engage independent licensed professionals, such as:
    • Chartered Accountants (CAs): For audit services, financial certifications, and statutory attestations, requiring professional certification for and on behalf of our client
    • Company Secretaries (CSs): For compliance certifications and regulatory attestations for and on behalf of our client
    • Cost and Management Accountants (CMAs): For cost audits and management accounting certifications for and on behalf of our client
    • Advocates/Law Firms: For legal advice, legal representation in litigation, and regulatory defence, including representation for and on behalf of our client before the concerned authorities.
    • Setindiabiz cannot perform these regulated services and must be performed by appropriately licensed professionals. When you require such services, Setindiabiz coordinates the engagement and ensures the independent professional provides the necessary regulated service.
  • Quality Assurance: Our hybrid model allows Setindiabiz to maintain quality control and consistency across our in-house services while ensuring that appropriately qualified and licensed professionals deliver regulated services in compliance with professional standards and regulations.

2. SETINDIABIZ IS A TECHNOLOGY-ENABLED SERVICE PLATFORM

  • Setindiabiz is India's leading technology-enabled platform that connects businesses in India and from overseas with independent experts who specialise in various domains, including Legal, Tax, Compliance, Environmental, Sustainability, Audit, and Product Certifications.
  • In-House Service Delivery: Setindiabiz delivers the majority of our services in-house through our own team and support staff. We manage client relationships, provide an online interface for support and updates at https://support.setindiabiz.com/portal/en/home, and assist with documentation and filing support.
  • Regulated Services & Independent Professionals: Where applicable law or regulation requires a licensed professional to perform specific services such as attestations, certifications, audits, legal advice, legal representation, or other regulated functions, we engage an independent licensed professional from our panel on your behalf. These professionals act independently in their individual capacity and are not bound by Setindiabiz or vice versa. For litigation management, Setindiabiz coordinates and supervises the process administratively; legal advice and representation are provided by external Advocates or Law Firms engaged on your behalf.
  • No Solicitation Advertising: These independent professionals are not advertised by us for solicitation purposes. We do not publicly publish their identities or credentials. Client information remains private until you communicate directly with a chosen professional or through us.
  • Hybrid Service Delivery Model: Setindiabiz operates on a hybrid service delivery model combining in-house expertise with independent professional engagement where legally required. For the majority of our services, including incorporation, licensing, compliance, accounting, and tax, our in-house team of experienced professionals delivers high-quality services to ensure the highest standards. However, for services that require a licensed professional by law or regulation (such as attestations, certifications, audits, legal advice, legal representation, or other regulated functions), Setindiabiz engages independent licensed professionals from our panel on your behalf. Setindiabiz collects bundled payments from clients based on agreed-upon milestones and reimburses independent experts at rates agreed upon between Setindiabiz and such experts. This hybrid approach allows us to maintain quality control over non-regulated services while ensuring professional compliance for regulated services.

3. NATURE OF SERVICES & PROFESSIONAL INDEPENDENCE

  • Setindiabiz In-House Service Delivery: Setindiabiz's in-house team directly provides the majority of business services, including incorporation, licensing, compliance, accounting, tax, and IP services. Our in-house professionals deliver these services in accordance with Setindiabiz's quality standards and responsibilities.
  • Regulated Services Require Licensed Professionals: Certain services, including attestations, certifications, audits, legal advice, and legal representation, are regulated by Indian law and can be provided only by licensed professionals (CAs, CSs, CMAs, Advocates). For these regulated services, Setindiabiz engages independent licensed professional(s) from our panel on your behalf.
  • Professional Independence for Regulated Services: When an independent licensed professional is engaged for a regulated service, that professional acts independently in their individual professional capacity. They are not our employees, representatives, or agents. They provide the regulated service in accordance with their professional obligations, ethics codes, and regulatory requirements applicable to their profession.
  • Setindiabiz is not a Law Firm, Audit Firm, or Professional Practice: Setindiabiz is a technology-enabled service platform. We are not a law firm, a CA firm, a CS firm, a CMA firm, or any other regulated professional practice. For in-house services (which do not require professional licensing), Setindiabiz is responsible for service delivery. For regulated services, the independent licensed professional is responsible for professional delivery and compliance.
  • Administrative Coordination: For litigation management, Setindiabiz coordinates and supervises the administrative aspects. Legal advice and representation are provided exclusively by external Advocates or Law Firms engaged for you.
  • No Solicitation Through Our Platform: These independent professionals are not advertised by us for solicitation purposes. We do not publicly publish their identities or credentials. Client information remains private until you communicate directly with a chosen professional.
  • Online Platform & Communication Facilitator: Our online presence facilitates communication between your business needs and our service providers (both in-house and independent professionals).     • Collect Bundled Service Fees: Collect a bundled service fee that comprises our service fee plus any included partner/third-party vendors or professional fees, as agreed and disclosed to you.
    • Disburse Professional Fees: Disburse fees and compensation to such independent professionals or partner/third-party vendors from the amounts collected from you or as otherwise agreed.
    • Make Statutory Payments: Make statutory payments on your behalf, including payments to the Registrar of Companies (MCA), GST departments, Income-tax authorities, Professional Tax authorities, Provident Fund (PF), and Employee State Insurance Corporation (ESIC) from advances you provide or to be reimbursed by you.
  • Authorisation Documentation: For companies and Limited Liability Partnerships, a Board Resolution is required. For non-corporate entities and individuals, a signed Consent or Declaration is required. Your authorisation continues until revoked in writing by you. Please ensure appropriate internal approvals (Board meetings, partner consents, etc.) are obtained before engaging our services.

6. FEES, TAXES & REIMBURSEMENTS

  • Pricing & Third-Party Fees: Our quoted prices may exclude government fees, regulatory filing fees, or third-party charges unless explicitly stated otherwise. Government and portal fees are payable by you at actuals. Any out-of-pocket expenses incurred by independent professionals on your behalf are reimbursable by you.
  • Payment Gateway & Processing Charges: Payment gateway charges, if non-refundable, may be netted from refunds or adjustments where applicable under our Refund and Cancellation Policies.
  • Transparent Billing: All fees, taxes, and charges will be clearly communicated to you before service commencement, and any changes in the statutory fee after commencement of the work shall be promptly informed to you, and based on your approval, we will proceed with the assigned work. Any change in the scope of work will lead to changes in the fee structure. We strive to provide transparent billing and will itemise all costs associated with your engagement.

7. MILESTONES & TIMELINES

  • Regulatory Dependencies: Timelines for service delivery depend on factors such as regulatory approvals, government processing times, and the completeness and accuracy of the information you provide. Estimated timelines provided by Setindiabiz are best-effort estimates and are not guaranteed. Delays caused by regulatory bodies, government departments, or delays in providing information and documents by the client are beyond our control and will prolong the timelines for completion of work.
  • Best-Effort Commitment: We commit to pursuing your matter diligently and keeping you informed of progress. However, we cannot guarantee specific completion dates where regulatory approvals or third-party decisions are involved.

8. CANCELLATIONS & REFUNDS
