Why Did the High Court Step In?

The Court’s intervention follows multiple petitions highlighting how bad actors are using stolen PAN and Aadhaar details to set up ghost entities.

In one striking instance before the Bench, a petitioner discovered that two fake GST accounts had been opened in her name without her knowledge — and those accounts were subsequently linked to an unauthorised attempt to siphon off over ₹4.46 crore from her savings account.

Official figures submitted to the Court underscore the systemic scale of the issue:

  • FY 2023–24: 2,800 fake GST registrations detected, involving tax evasion of ₹15,085 crore.
  • FY 2024–25: 1,654 fake GST registrations detected, involving tax evasion of ₹13,109 crore.

Key Highlights of the Interim Order

To plug these structural vulnerabilities, a Division Bench comprising Justice Anil Khetarpal and Justice Shail Jain directed GST officers across the country to strictly enforce biometric Aadhaar authentication for every new applicant.

While biometric verification was previously reserved only for applications flagged as “high risk” by automated data tools, the Court noted that past administrative promises to roll out biometric checks comprehensively had stalled in practice.

Recognising potential operational challenges, the High Court has allowed GST authorities the liberty to approach the Bench if they face practical hurdles while implementing the directive on a national scale.
