The Central Board of Direct Taxes (CBDT) has published an operational guidance note establishing statutory tax reporting protocols for Reporting Crypto-Asset Service Providers (RCASPs). Formulated under statutory powers under Section 509 of the Income-tax Act and operationalised through Rules 241 to 244 of the Income-tax Rules, this framework aligns domestic tax monitoring with the Organisation for Economic Co-operation and Development (OECD) Crypto-Asset Reporting Framework (CARF).

Core Statutory Obligations Under Guidance Note

While basic taxation rates on Virtual Digital Assets (VDAs) remain unchanged, exchanges, trading desks, custodial wallet providers, and Web3 entities operating in India must upgrade their internal administrative procedures:

  • Mandatory Due Diligence: Entities must collect, verify, and retain valid self-certifications, foreign or domestic Taxpayer Identification Numbers (TINs), and tax residency declarations cross-referenced against PMLA customer due diligence standards.
  • Annual Disclosures via Form 167: Service providers are legally required to log gross transactional values – encompassing crypto-to-crypto exchanges, fiat conversions, and retail transfers – for annual filing on Form 167.
  • Cross-Border Tax Intelligence: The guidance note establishes standardised digital audit trails to facilitate automated annual information exchanges with foreign tax authorities in CARF-signatory jurisdictions.
