Overview: The Goods and Service Tax (GST) registration cancellation process has changed from 1st November 2026. Under the revised Rule 20 of the CGST Rules, eligible applications can now be approved electronically without an order from a tax officer. The process depends on timely return filing, payment of outstanding dues and, for certain taxpayers, the output tax liability on sales to registered businesses. A special three-day GSTR-10 condition also applies in specified cases.
A business that closes down, transfers its operations or no longer needs Goods and Service Tax (GST) registration must formally apply for cancellation. Simply stopping business activities does not bring the registration to an end. Until cancellation is completed, the business must continue to meet its applicable GST obligations.
The GST registration cancellation procedure has changed from 1st November, 2026. The GST portal can now process eligible cancellation applications electronically, reducing the need for routine examination by a tax officer. However, businesses must first meet the prescribed conditions. These include filing pending returns, clearing outstanding dues and reporting the stock and input tax credit held at the time of cancellation.
Applicability and Circumstances for Filing GST Cancellation
Section 29(1) of the CGST Act, 2017, allows a person, business, entity, or company to apply for GST cancellation in specified situations, like:
- The business has closed or discontinued its operations.
- The business has been transferred or otherwise disposed of.
- A change in the business constitution results in a change of PAN.
- The business has been merged or demerged.
- The person is no longer required to remain registered under GST.
- The sole proprietor has died and the legal heir applies for cancellation.
File FORM GST REG-16 within 30 days of the event leading to cancellation. This time limit does not apply to an application filed by the legal heir of a deceased sole proprietor.
Where a change in ownership or constitution results in a new PAN, a fresh GST registration is required rather than a transfer of the existing one.
Clear pending returns and GST dues first
The revised Rule 20 makes return filing and payment of dues important conditions for cancellation. Before applying, businesses should check the following:
| No. | Requirement | What needs to be done |
|---|---|---|
| 1 | Earlier tax periods | File all due returns and statements, including CMP-08 where applicable. |
| 2 | GSTR-1 or IFF already filed | File the corresponding GSTR-3B before submitting the cancellation application. |
| 3 | Remaining period | File the applicable returns for the period up to the cancellation application or effective cancellation date, as required. |
| 4 | Outstanding dues | Pay the tax, interest, late fee, penalty and other amounts payable. |
During processing, the portal verifies return filings and tax payments. If an applicant fails to fulfill these requirements, automated approval is withheld, and the application is sent to the “proper officer” for review.
Under Rule 20(4), submission of the application places the GST registration under suspension until all cancellation proceedings are fully concluded.
Treatment of Stock and Input Tax Credit
When submitting an application for cancellation, taxpayers must account for all inputs, finished goods, and capital goods held in stock. In accordance with Section 29(5) of the CGST Act, the taxpayer is required to pay either the tax due on the value of such stock or the equivalent input tax credit amount attributable to it, whichever is higher.
When calculating the tax liability for capital goods, the remaining useful life is determined using a standard statutory lifespan of five years. The step-by-step mechanism for this computation is prescribed under Rule 44 of the CGST Rules.
Prepare a stock statement and calculate the amount payable before filing FORM GST REG-16. If purchase invoices for some inputs are unavailable, their value must be estimated using the prescribed method.
Rule 44 of the CGST Rules sets out the step-by-step procedure for this calculation. Before submitting FORM GST REG-16, draw up a stock statement to determine the payable amount. If purchase invoices for specific inputs are not traceable, there are prescribed rules for their valuation.
Furthermore, cancelling a registration does not absolve a business of past tax liabilities. As per Section 29(3), any outstanding obligations incurred prior to cancellation remain fully payable.
Automatic revised GST cancellation
The GST portal can now process eligible cancellation applications electronically, without waiting for a tax officer to pass an order. The system first checks whether the required returns are filed and outstanding dues are paid.
An additional check applies to specific taxpayers regarding their GST output liability on sales made to registered businesses. The ₹2.5 lakh threshold is the criteria for this evaluation.
| No. | Taxpayer category | What happens to the application? |
|---|---|---|
| 1 | Composition taxpayers, non-resident taxable persons, OIDAR service providers and Input Service Distributors | The portal can process cancellation electronically once the return and payment conditions are met. |
| 2 | Regular, casual and SEZ taxpayers with B2B output tax liability of up to ₹2.5 lakh in every relevant period | The portal can process cancellation electronically, subject to the other conditions. |
| 3 | Regular, casual and SEZ taxpayers with B2B output tax liability above ₹2.5 lakh in any relevant period | The portal may require GSTR-10 to be filed within a special three-day period before electronic cancellation. |
| 4 | Applications with pending returns or unpaid dues | The application is referred to the proper officer. |
The system checks the relevant periods from the date of registration up to the date of the cancellation application. If the application is approved electronically, the cancellation communication is issued in FORM GST REG-38. Where an officer handles the application, the cancellation order is issued in FORM GST REG-19.
The three-day GSTR-10 deadline
The three-day GSTR-10 requirement does not apply to every business. It is linked to the higher B2B tax liability category described above.
The GSTN advisory clarifies how the three days are counted:
- When an application displays the status “Pending for Returns Filing” due to pending return due dates, the three-day period commences on the official due date for those returns.
- If the application does not pass through this stage, the three days start from the date of the cancellation application.
- Filing GSTR-10 within this period allows the application to proceed for electronic cancellation, subject to other conditions.
- If the return is not filed in time, the application is sent to the “proper officer”.
This special deadline is separate from the normal GSTR-10 filing requirement. Under Section 45 of the CGST Act, the final return is generally due within three months from the date of cancellation or the date of the cancellation order, whichever is later.
Where an application is referred to an officer and the officer subsequently cancels the registration, the GSTN advisory specifies a 90-day period from the effective cancellation date for filing GSTR-10, wherever applicable.
Process for Examination of Application by a Tax Officer
Not every application will qualify for electronic cancellation. If the prescribed return or payment conditions are not met, the GST portal sends the application to the proper officer.
The officer can seek further information or documents before deciding the application. The revised Rule 20 sets the following timelines:
| No. | What happens | Form | Time limit |
|---|---|---|---|
| 1 | The officer seeks clarification or documents | FORM GST REG-03 | Within 15 days of receiving the application |
| 2 | The applicant submits a reply | FORM GST REG-04 | Within 15 days of receiving the notice |
| 3 | The officer approves or rejects the application | FORM GST REG-19 or FORM GST REG-05 | Within 15 days of receiving the reply |
| 4 | The applicant does not reply | Rejection communicated through FORM GST REG-05A | If no reply is received within the prescribed period |
These are the total number of days, not working days. The rules also provide for deemed approval if the officer does not take the required action within the applicable period.
Remember one distinction: FORM GST REG-38 is used when the portal completes cancellation electronically, whereas FORM GST REG-19 is the order issued through the officer-led process.
Five checks before filing FORM GST REG-16
Conducting a few essential checks prior to submitting the application can prevent processing delays and safeguard against receiving a notice from the tax department:
- Confirm the cancellation date: Give the correct reason for cancellation and select the appropriate effective date.
- Check pending returns: Reconcile GSTR-1, GSTR-3B, CMP-08 and other applicable returns.
- Clear outstanding dues: Pay the tax, interest, late fee and other amounts payable.
- Prepare the stock details: Account for inputs, finished goods and capital goods, and calculate any amount payable towards input tax credit.
- Check the B2B tax liability: Review GSTR-1, GSTR-1A or IFF to see whether the ₹2.5 lakh threshold and special GSTR-10 requirement apply.
Revised FORM GST REG-16 from December 2026
A revised FORM GST REG-16 will come into effect on 1st December, 2026. The updated form asks whether the applicant wishes to file a NIL return for the period between the last tax period for which a return was filed and the effective cancellation date.
It also updates the details to be provided about stock and input tax credit. Businesses filing from 1 December should use the revised form available on the GST portal.
The new cancellation procedure began on 1 November, while the revised application form follows a month later.

FAQs
The revised Rule 20 came into effect on 1st November, 2026. The revised FORM GST REG-16 will apply from 1st December, 2026.
No, not for every applicant. The portal can cancel eligible applications electronically if the prescribed return, payment and other conditions are met. Other applications may be referred to a tax officer.
It refers to the output tax liability on sales made to registered businesses, as reported in GSTR-1, GSTR-1A or IFF. It is not a turnover limit.
The special three-day deadline applies only in specified cases involving B2B output tax liability above ₹2.5 lakh. The period is counted from the relevant return due date or, where that stage does not apply, from the date of the cancellation application.
Under Section 45 of the CGST Act, GSTR-10 is generally due within three months from the date of cancellation or the date of the cancellation order, whichever is later. The special three-day requirement is separate.
The prescribed returns and statements must be filed to meet the cancellation conditions. If returns or payments remain incomplete, the application may be referred to the proper officer.
Cancellation does not remove tax dues or other obligations relating to earlier periods. The business must also account for the applicable input tax credit or tax payable on its stock and capital goods.
FORM GST REG-38 communicates cancellation completed electronically by the GST portal. FORM GST REG-19 is the cancellation order issued through the “proper officer” process.
The new system can make GST cancellation quicker for businesses that meet the prescribed conditions. But automatic approval is not guaranteed. Pending returns, unpaid dues and the B2B tax liability test can affect how an application is processed. Businesses should check these matters before filing FORM GST REG-16 and follow the application until cancellation is confirmed.
