Hotels/Restaurants, Providers of Other Prepared Food
Analysis report (Chemical & Bacteriological) of Vending water to be used as an ingredient in food in a Food Establishment, Club/Canteen or any. The report must be from a recognised public health laboratory. It is required to confirm the potability of water used in food. The water analysis report is to bear the date of collecting the sample and the name of the staff member of the Lab who collected the sample (It is applicable where water is used as an ingredient)

Recall Plan & Import Export Code (IEC). An IEC certificate is a document issued by the Director-General of Foreign Trade(DGFT).

Pesticide residues report of water for units engaged in manufacturing packaged drinking water, packaged Mineral water and carbonated water. The report must be from a recognised public health laboratory. It is required to confirm the potability of water used in food. The pesticide residue report is to bear the date of collecting the sample, the name of the Lab staff who collected the sample, the Source of raw water and the treatment plan.
Step Wise Process for Grant of FSSAI State License
Step 1: Eligibility Check
The process starts with the eligibility check of the applicant FBO. In this, the experts at setindiabiz will discuss the nature of the proposed business plan in detail and help you find your eligibility as per your proposed requirements.
Step 2: Documentation & Drafting
Once it is determined that you need food registration. The Setindiabiz team will provide you with a list of documents. Based on the requirement setindiabiz team will help you with draft documents for the necessary signature.
Step 3: Online Application Filing
The online filing will be made by filing Form-A at the online portal of FoSCoS. In this course, we will interact with you for OTP.
Step 4: Payment of Government Fee
Once the application is filled and the documents are uploaded in the document section, the payment of the registration fee is made, and a reference number is generated. It is a temporary number to track the status of the application.
Step 5: Track status of FSSAI Application
The applicant can track the status of the application online. Usually, licencing authorities grant registration within seven days of the application filing, but if they opine for inspection of premises, it will delay the grant of Food registration. On inspection, registering authority may raise the clarification in the application requiring modification, addition or deletion in the application.
Step 6: Reply to Clarification
The reply to clarification must be filed within 30 days from the date when raising clarification. If not, this will lead to refusal of the application, and a new application needs to be filed. There is no process of refunding the fee. The Setindiabiz team will coordinate with you at the time of such clarification to resolve the same.
Step 7: Grant of Registration
On approval of the application, the Registration Certificate and photo ID Card will be issued to the applicant, which has to be displayed at a conspicuous place at the food business premises. Registration certificate has a photo FBO, Q.R. code and 14 digits FSSAI registration number that starts with numeric 2.
Timeline for Grant of FSSAI State License
Timeline: The Licensing Authority issues a license within 60 days of receiving a complete application by an FBO. It includes the time taken in the scrutiny of the application and the inspection of the premises by the concerned authority. This timeline may be practically extended in case clarification is raised in the application by the concerned authority. The applicant receives 30 days to file a reply to the clarification raised in his application. Delay in filing a response by the applicant to resolve the clarification may lead to the automatic rejection of the application.
Commencement of Business: The licensing authority for food business shall not prohibit the food business operator from commencing its food business where the licensing authority is unable to grant a Food licence within 60 days from the date of making a complete application, and:
- Fails to point out the defect in the application or
- No clarification is asked after inspection of the food unit by the food officer
“The above provision of commencement of Food business without grant of licence is to curb the delay tactics of the concerned Licensing Authority without any valid reason.”
Validity of FSSAI State License
According to a new order by the FSSAI, dated 11th January, 2023, applications filed after the 12th of January, 2023, a Food State License granted under these Regulations shall be valid for a period of 1 year only. The validity period of the licence is counted from the date of issue of the licence and can be auto-renewed for a further period of 1 year at a time, subject to the following conditions :
- There is no change in the existing details of the license.
- The license to be renewed is not cancelled/suspended
- If the renewal is applied by manufacturers and importers, FoSCoS ensures that they have filed their annual returns before applying for renewal.
However, the order does not clarify whether an application for renewal can be filed if the following conditions are not satisfied, and or if the applicant seeks a renewal for a period exceeding 1 year.

Any renewal application filed within 180 days after the license has expired will attract the penalties:
The FSSAI widened the window to file an application for FSSAI license renewal. According to the window, the window to apply for the renewal of the FSSAI license starts 180 days prior to the expiry of the license, and extends up to 180 days after the license expires. The designated officers may order an inspection before renewal if considered necessary for reasons to be recorded in writing. No inspection is required if the Food Business Operator has a valid certificate from an agency accredited by the Food Authority, an accredited food safety auditor, or any other organisation notified by FSSAI.
- Three times the existing annual license fee in the period from the 1st day to the 90th day after the original expiry date.
- An additional two times of the existing annual license fee (i.e., a total of 5 times of the original license fee) from the 91st day to the 180th day after the original expiry date.
No renewal application can be filed after the expiry of 180 days from the date on which the license originally expired. Further, FBOs shall not be allowed to conduct any food business in the period between the original expiry date and the issuance of the renewed license. Any food business conducted in such a period will be subject to the penalties and punishment as per Section 63 of the FSS Act, 2006.
Overall Cost of Getting the FSSAI State License

The government fee payable for the FSSAI State License is paid based on the business activity of the FBO. As the license may be obtained for a period of up to one year, the government fee is calculated accordingly.

Penalty for Non-Compliance
A food licence is mandatory before the start of the food business. A food business operator carrying on a food business without a valid licence may be levied a fine of up to Rs 10 lacs or an imprisonment of six months. Still, in some cases where the grievous injury is caused due to unsafe food provided by the FBO, the imprisonment could exceed 6 years. Further, if the FBO is found guilty under this Act, all the directors /Partners/managers/secretaries of the FBO shall also be liable to be proceeded against and punished under this Act. Thus, the FBO must procure the required Registration or licence before starting the food business and comply with the conditions imposed therein.
Annual Return
Every FSSAI-licensed FBO involved in the Manufacturing and Importing of Food Products, including those engaged in the manufacturing of Milk and Milk Products, shall furnish online periodic annual returns with effect from FY 2020-21 as per the notification dated 18th Dec 2020.
The returns shall be submitted on the Food Safety Compliance System (FoSCoS) not beyond 31st May for each year. Every licensee shall file a separate return for each License, i.e. for each food unit. It is immaterial that the same Food Business Operator holds more than one License. From FY 2021-22 onwards, any delay in filing a return beyond 31st May of each year shall attract a penalty of Rs 100 per day of delay. However, the maximum penalty levied will not exceed 5 times the actual prescribed government fees.
Exemption From Annual Return under FSSAI
- Food Business Operators (FBOs), including Petty Food Business Operators holding an FSSAI Registration Certificate, are not required to submit annual returns.
- Presently, the provision of annual return submission is not applicable for other Kind of Businesses (Such as Distributor, Wholesaler, Retailer, Storage, Transporter and Food. Services etc).

The Licensing Authority shall issue the licence within 60 days of making a complete application by an FBO. The said period of 60 days includes scrutinising the application and inspection of premises by the concerned authority.
As per Section 32 of the Food Safety and Standards Act, 2006, if an FBO is aggrieved by the decision of the concerned licensing or registering authority, it may appeal to the Commissioner of Food Safety of the state in which the unit is located.
Though FSSAI Act does not provide for obtaining other permission or Registration before making any application for FSSAI License/Registration, an FBO shall ensure that all the permissions are taken as prescribed by the District/Local Administration before commencing food business activities.
The window for filing the application for Food license or registration opens 180 days before the license is supposed to get expired and closes 180 days after expiry of the license.
A late fee of Rs.100 per day is applicable, if the application for food license renewal is filed within 180 days after the date on which the license’s validity has expired. You cannot file the application after 180th day from the date on which the license expired. So, the FBO will calculate the number of days of delay and multiply the same with Rs.100 to arrive at a late fee. The total fee will be a Late fee plus the renewal fee of the License. i.e. if a renewal application is filed on the last day of expiry of validity, a late fee is levied. The calculation of the total fee paid on a renewal is as under:
- No. of days of delay = 30 DAYS
- Late fee = Rs. 100 x 30 = Rs. 3000
- Renewal Fee = Rs. 2,000 for 1 year (According to the new circular, license cannot be renewed for more than a year at a time)
- Total fee Paid for renewal application = Late Fee + Renewal Fee = Rs. 3000 + Rs. 2000= Rs. 5000)
The Licensing authority will send FSSAI License or Registration containing Q.R. code to email ids of persons nominated by the FBOs after its issuance. Please ensure the email- IDs filled in the application were correct in case of non-receipt of the License or registration mail.
