Setindiabiz Private Limited (“Setindiabiz”, “we”, “us”, or “our”) operates a technology aggregator and techno-legal platform connecting clients with a network of experts, including Chartered Accountants (CAs), Company Secretaries (CS), Cost and Management Accountants (CMA), CPAs, Valuers, Insolvency Professionals, Lawyers, and Other Consultants (collectively known as “Experts”). We always strive to ensure that the services you avail through our website are satisfactory and the best in the industry at highly reasonable and affordable rates.

There is no promise of Specific Performance

Please note that the experts on the platform www.setindiabiz.com and the team setindiabiz work in good faith to deliver their services to the best of their abilities. However, the performance of the service is subject to several factors, such as the quality of documentation, eligibility, and the discretion of government officers. Therefore, we do not guarantee any specific outcomes and cannot be held responsible for any adverse consequences that may arise from such outcomes. Additionally, please bear in mind that we cannot be held accountable for delays caused by circumstances beyond our control, such as national or departmental holidays, delays by the Government of India or state governments, acts of God, natural disasters, riots, sabotage, labour shortages, or technical failures.
If the government authorities reject your application for reasons beyond our control, we cannot process refund requests. If you choose to reapply after rejection, you will be required to pay 70% of the professional fees and 100% of the government fees, as well as any additional travel and miscellaneous expenses associated with the assignment. We will create a new order for you once we approve, provided you agree to these terms. Please note that government authorities may levy penalties or fees for any reason, and you are responsible for paying them. We will not be held accountable for any actions or penalties the government authorities impose. Please be aware that in professional services, time is a valuable asset, and every piece of advice or engagement during a call has a cost.

Cancellation & Refund

However, there may be situations where you need to cancel an order and request a refund. We understand that there may be a genuine concern, and we are open to discussing and deciding each case’s merits. Please send your request for cancellation or refund to our email id “help@setindiabiz.com”. We would like to inform you that requests for cancellation and refund will be considered on a case-to-case basis. We may issue a full or partial refund or deny the request for a refund, depending on the specific circumstances. Please note that we reserve the right to make the final decision regarding the approval or denial of any refund requests.

1. Cases for Full Refund

  1. If you decide to cancel your order, please notify us within 4 hours of placing the order or payment via email at help@setindiabiz.com. We will refund 100% of the amount received, provided we have yet to start working on the order or assigned the work to an expert.
  2. If you place an order by mistake or accidentally make multiple payments for the same order, or if you pay us more than the agreed cost of service, then you are entitled to a refund of the excess amount that we would have received.

2. Cases Where We Issue Partial Refunds

  1. Suppose our scrutiny team or analysts determine we cannot provide the requested service due to the client’s ineligibility or failure to provide the required documents or information. In that case, we may issue a partial refund. However, we will deduct 25% towards handling charges to cover our expenses. Please note that this refund policy will only apply if we have not assigned an expert to the order and if the client has provided all information truthfully and entirely when placing the order without withholding any material information. It is essential to understand that time is a valuable resource in professional services, and every piece of advice or engagement during a call has a cost.
  2. Please take note that any request for cancellation or refund submitted to us after four hours of placing the order will be subject to our policy, which may result in a denial of refund or a partial refund at the sole discretion of the management of Setindiabiz. However, there will be a minimum deduction of 25% to cover costs. Please keep in mind that in professional services, time is a valuable asset, and any advice or engagement during a call has a cost.
  3. Please note that if you have submitted all the necessary documents, qualifications, and facilities for your service order. Still, our network of professionals needs to be more experienced in providing the required services or unwilling to work on your assignment; we reserve the right to assign the service order to other professionals in our network. If, after 30 days, none of the professionals can provide the services you require, you may request a refund by writing to us at help@setindiabiz.com. However, please note that in such cases, we will deduct 25% from the refund amount towards our effort, expenses, and miscellaneous costs, subject to our sole discretion.

3. Cases For No Refund (Denial of Refund)

  1. You agree that you fully understand all the applicable government fees, compliance requirements, necessary paperwork, and any other facilities, infrastructure, land, or commercial premises required to secure a license, registration, certification, or government approval/clearance. You are responsible for providing all necessary documents and information to obtain such license, registration, certification, or approval/clearance, as requested by our network of experts. If you fail to provide such information or documents, then there will be No Refund.  
  2. Please note that if you do not respond to our email, call or WhatsApp message within seven (7) days, your order will be cancelled and closed. Unfortunately, we cannot issue any refunds under these circumstances. However, if you decide to resume the order, you will be required to pay 70% of the professional fees and 100% of the government fees. Additionally, you will need to cover any extra travel and miscellaneous expenses related to the assignment. Once we receive your approval and you agree to these terms, we will create a new order for you.  
  3. No Refund shall be made after the order is assigned to the network of experts such as Chartered Accountants (CAs), Company Secretaries (CS), Cost and Management Accountants (CMA), CPAs, Valuers, Insolvency Professionals, or Lawyers.
  4. By placing an order with us, you undertake that you are not an agent, middleman, or unregistered Legal professional in any manner; you are aware that setindiabiz.com is a techno-legal platform solely designed for businesses or individuals seeking legal services. In case any service order is received from the middleman or unregistered professionals or professionals outside the Setindiabiz network, such orders shall be considered a violation of platform principles.   5. If, due to a change in law, our network of professionals is unable to provide the services you require, and you are unable to comply with the revised regulatory norms set by the government, we will not issue a refund.

Refund method

We will refund the approved amount by the management to the original payment method used for the transaction. However, in some cases, we can issue a refund to the bank account of the entity that placed the order. Refunds will not be issued to any third parties under any circumstances. Eligible refunds will be processed within a minimum of 15 days from the approval by Setindiabiz.

Escalation Matrix

  • Level 1: Email us at help@setindiabiz.com. This may take a week to finalise the decision.
  • Level 2: If you are unhappy or unsatisfied with Level 1, you may appeal to our grievance officer at complaints@setindiabiz.com. This may take seven (7) working days to conclude.

Dispute Settlement

In case of a dispute between parties regarding order cancellation or refund requests, the exclusive jurisdiction for such cases shall lie with the courts in Delhi. It is important to note that the provisions of The Arbitration and Conciliation Act, 1996 shall not apply to these cases.
