Examination & Reply

Registration Certificate

Process of Trademark Registration in India
Step 1: Trademark Classification & Public Search
Trademarks are categorised into 45 classes under the NICE Classification — Classes 1-34 for goods and 35-45 for services. We identify your appropriate class and conduct a thorough search of the IP India database for identical or similar marks.
Step 2: Documentation for Trademark Filing
Trademark filing is entirely online — no physical documents required. Scanned copies of ID proof, logo (JPEG), Power of Attorney, and User Affidavit (if claiming prior use) are uploaded. We assist you with a simple questionnaire for seamless documentation.
Step 3: Filing of Trademark Application
A trademark application is filed online in Form TM-A through a registered Trademark Attorney as per Section 145 of the Act. We share the draft for your approval and file within 24 hours of confirmation, subject to portal availability and complete documentation.
Step 4: Reply to Examination Report
The Examiner reviews your application under Sections 9 and 11 of the Act. If objections are raised, a reply must be filed within 30 days. We draft and file a comprehensive response addressing all objections raised in the Examination Report.
Step 5: Show Cause Hearing (If Required)
If the Examiner is not satisfied with the written reply, a personal hearing is scheduled via video conferencing. Our experienced Trademark Attorneys represent you at the hearing and present arguments to overcome the objections raised.
Step 6: Publication in Trademark Journal & Opposition
Once approved, the trademark is published in the Trademark Journal. It remains open for opposition for 4 months from the publication date. If no opposition is received within this period, the trademark is automatically registered.
Step 7: Trademark Registration Certificate
The Registrar issues a Digital Trademark Registration Certificate valid for 10 years from the application date, renewable indefinitely. You gain exclusive rights under Section 28 and can legally use the ® symbol with your registered mark.

Q1. What is the total cost of trademark registration in India?
Total cost = Professional Fee (₹1,999 onwards) + Government Fee + GST. Government fee is ₹4,500 per class for Individuals, DPIIT-registered Startups, and Udyam-registered MSMEs. For Companies, LLPs, and other entities, it is ₹9,000 per class. This 50% concession is available under the Trade Marks Rules, 2017.
Q2. What is the difference between ™ and ® symbols?
The ™ (Trademark) symbol can be used immediately after applying to indicate a claim over the mark. The ® (Registered) symbol can only be used after the trademark is officially registered. Using ® without valid registration is a punishable offence under Section 107 of the Trade Marks Act, 1999, with imprisonment for up to 3 years or a fine of up to ₹2 lakhs.
Q3. How long does trademark registration take in India?
Typically, 8-12 months if there are no objections or oppositions. The timeline includes: Filing & TM Number (1-2 days) → Examination Report (2-4 months) → Reply & Acceptance (1-2 months) → Publication & Opposition Period (4 months) → Registration Certificate. Contested applications may take 2-3 years.
Q4. How long is trademark registration valid?
Trademark registration is valid for 10 years from the date of application (not registration). It can be renewed indefinitely for subsequent 10-year periods by filing Form TM-R and paying the renewal fee. A 6-month grace period is available for late renewal with additional surcharge under Rule 66 of the Trade Marks Rules, 2017.
Q5. What is NICE Classification for trademarks?
NICE Classification is an international system that categorises all goods and services into 45 classes — Classes 1-34 for goods and Classes 35-45 for services. Trademark protection is limited to the class(es) in which it is registered. Multi-class applications require separate government fees for each class.
Q6. Can I register a trademark I haven’t used yet?
Yes. You can file a “proposed to be used” application under Section 18(1) of The Trade Marks Act, 1999. No usage affidavit is required in such cases. However, marks with proven prior usage may have stronger claims in case of conflicts or opposition proceedings.
