A startup once registered, whether as a company or an LLP or any other form of business need certain licenses or registration which is required under various acts of parliament or state legislature, one of such important registration required is from shops and establishment act(s) passed by different state governments. The general purpose of shops and establishment acts are to regulate payment of wages, working hours, leave, holidays, general employment conditions etc.
The Legislation: Most of the state governments have passed their own legislature or have adopted some other state government legislation, we are providing professional services in the matter of registration of establishment and compliance of various provisions which may be required under respective shops and establishment acts.
Applicability : The legislation applies on all commercial establishment which includes shops, offices, schools, hospitals but also societies, charitable trusts, printing establishments, educational institutions which operates for the motive to earn profits. However, factories are not covered by the shops & establishments act and are regulated by the Factories Act, 1948.
A Shop shall mean any premises where any trade or business is carried on or where services are rendered to customers, and includes offices, storerooms, go downs, or warehouses, whether in the same premises or otherwise, used in connection with such trade or business, but does not include a commercial establishment or a shop attached to a factory where the persons employed in the shop fall within the scope of the Factories Act, 1948.
